1. Acceptance of Terms

By accessing or using ForgeOS, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Definitions

• Account: a registered user profile used to access the Platform.
• Content: all text, graphics, data, and software made available through the Platform.
• Platform: ForgeOS website and applications.
• User-Generated Content (UGC): data and materials You submit, including shared player cards, profile entries, and related uploads.

3. Eligibility and Account Registration

You must be at least 13 years old to use ForgeOS. You are responsible for complying with local laws and any location-based restrictions that apply to Your use of online services. You agree to provide accurate registration information and maintain account security.

We may suspend or terminate Accounts that violate these Terms, applicable laws, or platform safety standards.

4. User Conduct

You agree to use the Platform lawfully and respectfully. You may not:

• Cheat, hack, exploit vulnerabilities, or interfere with platform operation.
• Harass, threaten, or abuse other users.
• Use bots or automated workflows for unauthorized commercial scraping.
• Upload malicious code or unlawful content.

5. Content Ownership and License

You retain ownership of Your User-Generated Content. By submitting UGC to ForgeOS, You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and share that content solely to operate and improve the Platform, including public profile or player-card sharing features.

6. Intellectual Property

ForgeOS, its software, design, trademarks, logos, and non-user content are owned by the Company and protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or commercially exploit ForgeOS assets without prior written consent.

7. Payment and Fees

ForgeOS may provide a 14-day free trial. After trial, paid plans include Pro at $4.99/month and Team at $14.99/month (up to 5 players), unless otherwise stated at checkout.

• All subscriptions renew automatically until canceled.
• You may cancel at any time; cancellation applies to future billing periods.
• Fees are charged in USD.
• Payments are generally non-refundable unless required by law.
• Stripe is our payment processor and handles billing transactions.

8. Third-Party Links and Services

The Platform may link to third-party websites or services. We are not responsible for third-party content, policies, availability, or practices.

9. Disclaimers and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, ForgeOS will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for claims arising out of or related to the Service is limited to the greater of (a) USD $500 or (b) the amount You paid to ForgeOS in the prior 12 months.

10. Indemnification

You agree to defend, indemnify, and hold harmless ForgeOS from claims, damages, losses, and expenses resulting from Your misuse of the Platform, violation of these Terms, or infringement of rights of any third party.

11. Termination

We may suspend or terminate access at any time for violations, abuse, legal reasons, or operational risk. Upon termination, You may lose active access to features. Where technically feasible, legacy data may remain in read-only form for a limited period. UGC may be deleted according to retention and compliance requirements.

12. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

14. Dispute Resolution

Unless otherwise required by mandatory law, courts located in Frankfurt am Main, Germany have exclusive jurisdiction over disputes arising from these Terms or use of the Platform.

15. Changes to Terms

We may update these Terms from time to time. Material updates will be posted on this page with an updated date. Continued use of the Platform after changes means You accept the updated Terms.

16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

17. Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

18. Assignment

You may not assign rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with mergers, acquisitions, or asset transfers.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between You and ForgeOS regarding the Platform.
